That the Senate-

(a) notes:

(i) that 10 March 2010 is the 51st anniversary of the Tibetan uprising and the Dalai Lama's exile to India and the 2nd anniversary of the beginning of widespread unrest across Tibetan areas in 2008,

Situation in Eastern Burma

That the Senate-

(a) notes that:

(i) 9 March is an international day of action to raise awareness about the new military offensive against Karen civilians by the Burmese Army in Karen State, eastern Burma,

(ii) since mid January 2010 more than 2 000 civilians have been forced to flee new attacks in eastern Burma with villagers being shot on sight, more than 70 homes have been destroyed, schools and health clinics burnt down and the blocking of aid to people hiding in the jungle,

(i) the experience from around the world does not support claims from the Productivity Commission and others that removing territorial copyright protection would reduce the market price for books, and

Security Council meeting on nuclear disarmament and nonprolifer

Senator LUDLAM-I move the motion as amended:

 

That the Senate-

(a) notes that the United Nations Security Council will hold a summit on nuclear non-proliferation and disarmament on 24 September 2009 with the President of the United States of America, Barack Obama, presiding;and

(b) calls on the Government to:

(i) welcome the recent renewed optimism for a world free of nuclear weapons as expressed by the leaders of some nuclear weapons states,

(ii) affirm the commitment made at the 2000 Nuclear Non-proliferation Treaty [NPT] Review Conference to the diminishing role of nuclear weapons in security policies, and

(iii) urge all states possessing nuclear weapons to concrete and substantive action towards the elimination of their nuclear arsenals.

Afghanistan Elections

I move:
That the Senate notes:
(a) an international petition with 275 signatories, expressing the view that the presence of warlords, corrupt officials and incompetent leaders will not win freedom, peace, stability and prosperity for the people of Afghanistan;
(b) the petitioners call to the international community, the United Nations and the International Court of Justice to help the people of Afghanistan by bringing those warlords and criminals implicated in the Human Rights Watch report, Blood stained hands to the International Court of Justice; and
(c) the Human Rights Watch report implicates former warlords in crimes against humanity, which should preclude them from running in the election for the post of Vice President.

Toward nuclear disarmament

Burma Motion

Senator Ludlam - I move that the Senate:


(a) notes that:

(i) Daw Aung San Suu Kyi was sentenced to a further 18 months of house arrest in Burma on 11 August 2009,

(ii) this sentence will prevent her from participating in the proposed 2010 elections, and

(iii) the constitution establishing election procedures is fundamentally flawed and fails to achieve basic democratic standards; and

(b) calls on the Australian Government to investigate all possible options for progressing a United Nations Commission of Inquiry into war crimes and crimes against humanity in Burma.

Community TV

Senator LUDLAM-I move:

That the Senate:

1. Notes that:

a) It has been two years since Communications Minister Stephen Conroy attended Channel 31's Antenna awards and announced that "Community Television would not be left behind" in Australia's transition to digital television

b) Despite the Minister's assurances, there was no funding to facilitate community television's transition to digital broadcasting in this year's federal budget

2. Calls on the Australian Government to:

a) Immediately allocate the available digital spectrum to the current community television license holders

b) Provide funding to facilitate community television's transition to digital broadcasting and inform the Senate of a timeline to achieve this.

Birthday of Aung San Sui Kyi

Senator LUDLAM-I move the motion as amended:

That the Senate:

(a) notes that:

(i) 19 June 2009 is Aung San Suu Kyi's 64th birthday and also Women of Burma Day,

(ii) the arrest and trial of Aung San Suu Kyi under the oppressive state protection law has the sole intent of extending her illegal detention,

(iii) the United Nations (UN) Working Group on Arbitrary Detention said that her 13 years of detention is illegal under international and Burmese law,

(iv) thousands of villagers from eastern Burma fled to Thailand in June 2009 following military attacks on civilians by the Burmese army and allied armed groups, and

(v) between 1996 and 2007 thousands of villages were destroyed, abandoned or forcibly relocated in eastern Burma; and

(b) calls on the Australian Government to:

(i) increase its diplomatic pressure on its allies for a UN Security Council resolution on Burma and apply pressure in other forums for the release of Aung San Suu Kyi and all 2 100 Burmese political prisoners,

(ii) support a universal arms embargo against Burma, and

(iii) refuse to endorse the outcomes of the election in 2010 unless the political climate improves in
Burma.
